Master Deeds Comparative Analysis

UPDATE (03/28/14):  We had always asked to pay for what documents we had been able to get and were told it was not necessary.  But given the writing about charges for copies, we wanted to assure and let everyone know we had always asked.  Yes, there were subtle writings that could have given the suggestion we had been given free what should have been charged.  But, we always said we would pay and were told no payment was necessary.  We have scanned and posted copies to be viewed for free by all those accessing the links.  Of course, they may be downloaded, too.
Since our ideas have been used to a limited degree with no credit given to us, we suggest that all documents be made available online so that Unit Owners do not have to pay for copies and go through hoops of fire as we do on a regular basis.  We will continue to obtain documents and post them here at our cost since the developer controlled Boards and managements taking orders from them refuse full access as required under law.
The bill and receipt below are for copies of the insurance policies for Soho Central we were able to get while others were refused in a single request made.  The documents that were refused are contrary to Section 74 of the Corporation Code.

Master Deeds Comparative Analysis

This post will be updated as we obtain additional Master Deeds for all the condominium projects built by Century Properties.  As we all read the master deeds and by-laws a noticeable similarity as well as increased controlling additions are made with each new project.

Please send or supply us with your Master Deed plus other documents that may not be listed for scanning and posting.  If anyone has any comments and information to add in this analysis, please let us know your observations.

  1. the grammercy amendments to the master deed, as shown, are of dubious validity. per RA 7899, as even mentioned in the amendment, the amendment must be applied for approval by HLURB.

    the developer needs to submit proof of:
    1. prior written notification to ALL registered owners PLUS
    2. written consent from the simple majority of ownership based on floor area if a mixed use (residential/commercial) condominium.

    ask Grammercy to show the HLURB application for amendment of master deed, the proofs above, and the approval from HLURB.

    otherwise, Grammercy owners should take back all of the condo space that should be part of the common areas, which the developer is belatedly trying to steal away from the unit owners.
