Does everyone remember this among the wonderful ads and brochures and how about the salespeople and what they told us. I hear such fantasies continue. So after watching and remembering, cry and then laugh at the truth that is being exposed.

Holes in the Walls?

As some or many now know, there was the request from Greenfield to allow their workers to begin work on creating holes through the commercial floor and basement walls of Soho Central.  There were or may have been those secret & private meetings we are not allowed to witness as members of the Soho Central Condominium Corporation.  So what did or did not take place is a mystery since we are treated as children only told what those with assumed seats on the Board decide.  Do you like this?
 
As you may read in past messages we were told of a planned meeting.  At that time, we called HLURB's (Housing and Land Use Regulatory Board) records section to ask about a second amendment to the Master Deed that had supposedly allowed such structural changes to the building for development.  Ryan had spoken to the office and they said there was no second amendment and someone had come in the day before asking about it, too.  Well, well, someone?  Who?  Why?
 
I may have found out the reason with the reply I have now gotten from HLURB.

"This has reference to your queries regarding Master Deed with Declaration of Restrictions (MDDR) Amendments and Approval, to wit:

1. When an Amendment is made to the MDDR of a condominium prior to active selling of the units what entities must approve the Amendment if any?

2. What government agencies at this point would also need to get filed copies of the Amendment for it to be valid?

3. Once selling commences of the change in status of the project from its start then to buyers purchasing or whatever the status is called begins an amendment is made, do government agencies approve? Which ones must approve and which ones must have the filing of the Amendment for it to be valid?

Anent to your question 1 and 2, any condominium project intended for sale to the public must have an approved MDDR from HLURB and duly registered with the Register of Deeds concerned. It is one of the primary requirements for securing a License to Sell from this Office.

Relative to your question 3, an Amendment to the MDDR of condominium projects intended for sale to the public must first secure approval from this office and must be duly registered with the Register of Deeds concerned."

I had also been told back during the concern over a meeting about possibly allowing holes to be made due to a second amendment we do not have and have never seen that someone said there was one and it was notarized.  As I have told people, so what!  I could notarize a recipe for dog food and it means nothing unless filed properly.
